I don't know the FCC rule, but if you go to the westmarine.com site, they address this issue. They also have a Hummingbird VHF for $99, if it's the same model you're interested in, then it's no bargain...Westmarine products aren't known to be cheap. Also, for that price you could get a pair of
the FRS, and be legal. Whatever you decide to do, avoid being on CNN...they're ruthless.
